TN (Professional Visas for Mexican and Canadian Nationals)

PURPOSE

Allows U.S. employers to temporarily employ Canadian and Mexican workers in professional occupations that require theoretical and technical expertise in fields such as technology, engineering, education, medicine, sciences, among others as listed on the: Professions List

HOW

A U.S. employer with a legitimate business and a job opening that falls under one of the pre-approved USMCA/NAFTA occupations list. The Foreign National must possess the requisite education, training and/or experience required for the profession e.g. a Chemical Engineer has a Bachelor’s degree in Chemical Engineering.

Scientific Technician do not require Bachelor level degrees, but the ST must have theoretical knowledge of one of the following scientific areas: agricultural sciences, astronomy, biology, chemistry, engineering, forestry, geology, geophysics, meteorology, or physics, and work in support of and report to a degree professional in these scientific areas. So for example, a Scientific Technician working in Mechanical Engineering needs to report to a Mechanical Engineer with a Bachelor’s degree or higher in a related Engineering field.

Management Consultants are not required to have Bachelor level degrees, but they must have 5 years of experience in the field, or have been consulting for at least 5 years. 

PROCESS:

Process for Canadians: Canadian citizens can apply for admission as a TN nonimmigrant at a U.S. port of entry or during pre-flight inspection at an international airport in Canada.

Process for Mexicans: Mexicans must obtain a visa to enter the U.S. as a TN nonimmigrant by applying for a TN visa directly at a U.S. Embassy or Consulate in Mexico. You can select between the 1 year or 4 year visa.

Process from within the U.S. for nationals of either country: File form I-129 with USCIS with the required documentation and filing fees.

Other Information:

  1. Initial stay is granted for up to 3 years with one up to 3-year extension, indefinitely.
  2. Family (spouses and unmarried children under 21) can obtain TD visas. Spouses cannot work.
